longshoremen now set to destroy more jobs and businesses

So now the Longshoreman's union is now looking to get their hands into mucking about with the American economy.

Retailers pay royalties for each container moved by the unions based upon weight. These royalties are adjusted for inflation and, according to the Longshoreman's union, are used to compensate for the loss of jobs due to automation.

While that certainly might sound like a good deal, this disincentivizes businesses to innovate and artificially inflates consumer prices. Any savings that could have been passed to the consumer are now taken up by the unions.

Unions are every bit as greedy as corporations, and no moral, ethical, or economic standing in the 21st century.

DECEMBER 27, 2012 | BY TREVOR TIMM
Why We Should All Care About Today's Senate Vote on the FISA Amendments Act, the Warrantless Domestic Spying Bill

Today is an incredibly important vote for the future of your digital privacy, but some in Congress are hoping you won’t find out.

Finally, after weeks of delay, the Senate will start debate on the dangerous FISA Amendments Act at 10 am Eastern and vote on its re-authorization by the end of the day. The FISA Amendments Act is the broad domestic spying bill passed in 2008 in the wake of the warrantless wiretapping scandal. It expires at the end of the year and some in Congress wanted to re-authorize it without a minute of debate.

The good news is—thanks for your phone calls, emails, and tweets—Congress will now be forced to debate it, which means we can affect its outcome. In case you forget just how dangerous the FISA Amendments Act is to your privacy, here’s how we described it last week:

The FISA Amendments Act continues to be controversial; key portions of it were challenged in a case before the U.S. Supreme Court this term. In brief, the law allows the government to get secret FISA court orders—orders that do not require probable cause like regular warrants—for any emails or phone calls going to and from overseas. The communications only have to deal with "foreign intelligence information," a broad term that can mean virtually anything. And one secret FISA order can be issued against groups or categories of people—potentially affecting hundreds of thousands of Americans at once.

Any Senator who wants to stay true to the Constitution should vote no on its re-authorization, but in the alternative, there are four common sense amendments up for debate tomorrow that would go a long-way in curbing the law’s worst abuses.

The Wyden Oversight and Transparency Amendments

Sen. Ron Wyden, one of the most ardent defenders of civil liberties in the Senate, has been asking the NSA for months for information on how the FISA Amendments Act has impacted Americans.

The NSA has so far refused, yet, as the New York Times reported in 2009, we know the NSA was still intercepting domestic communications in a “significant and systematic” way. We also know the secret FISA court ruled, on at least one occasion, that the government had violated the Fourth Amendment when conducting surveillance under the FAA. Yet the NSA has rather unbelievably claimed releasing the number of Americans whose privacy has been violated would violate those same Americans’ privacy.

Ron Wyden’s amendment would force the NSA to come clean and give a general estimate of how many Americans have been affected by this unconstitutional bill, and finally give us information Americans deserve.

In addition, another Wyden amendment would clarify that the acquisition of American communications is prohibited without a warrant. Sen. Wyden has accused the government of conducting “backdoor searches,” whereby the government collects communications of foreign individuals talking to Americans, but later goes back into the government’s database of intercepted communications and reviews the Americans' comunications. Sen. Wyden hopes this clarification to the law will help guard against further intrusive spying on American communications.

The Rand Paul Fourth Amendment Amendment

Republican Senator Rand Paul has commendably been one of the few voices unequivocally denouncing the FISA Amendments Act as a violation of the Fourth Amendment. To that end, Sen. Paul will be introducing “the Fourth Amendment Protection Act” which will re-iterate that all US communications, whether sought by US intelligence agencies like the NSA or any government agency, are protected against unwarranted searches and seizures—even if they are held by third party email providers like Google. You can read Sen. Paul's amendment here.

The Merkley FISA Court Amendment

Both in 2010 and 2011, Obama administration officials promised to work to declassify secret FISA court opinions that contained “important rulings of law.” These opinions would shed light on whether and how Americans’ communications have been illegally spied on. Since then, the administration has refused to declassify a single opinion, even though the administration admitted in July that the FISA court ruled that collection done under the FAA had violated the Fourth Amendment rights of an unknown number of Americans on at least one occasion.

Starting with the precept that “secret law is inconsistent with democratic governance,” Sen. Jeff Merkley’s amendment would force the government to release any FISA court opinions that contain significant interpretations of the FISA Amendments Act so the American public can know how it may or may not be used against them.

The Leahy Sunset Amendment

About the only good part in the original FISA Amendments Act was the provision that stated it would expire after four years so Congress could fully debate its use and abuse before reauthorizing, if reauthorization was even necessary. Unfortunately, Congress has been resisting the debate, and the new bill would extend the FAA for five more years. That means the law would not sunset again until President Obama is out of office. Senator Leahy’s amendment would shorten the law’s length to three years. While any extension of a law that results in unconstitional spying is unacceptable, the shorter the re-authorization, the better.

Please use Free Press' call-in tool to talk to your Senator's office on the phone or use EFF's action center to email your Senators. Tell them to vote for these privacy-friendly amendments and to vote no on warrantless domestic spying.

Jewel v. NSA

She gets hit by a moose and drove to work in THIS

Well that's dedication for ya.

A central Newfoundland woman, who drove for about 40 kilometres after crashing into a moose this spring, said she still can't recall being in the accident.

In May, Michelle Higgins was travelling east on the Trans-Canada Highway from Norris Arm to Gander when a moose suddenly appeared on the road. Higgins's car collided with the animal.

She had no memory of it happening at the time, and seven months later, the accident is still a blank in her mind.

All Higgins can remember is getting out of her car upon arriving at her destination in Gander, and her co-worker rushing over to her in a panic.

"She said, 'You're full of blood.' I said, 'What do you mean?' She said, 'You're full of blood, and look at your car,'" Higgins said.

"When I turned around and looked at my car, I was devastated, because there was no roof. The windshield was gone. Like, I couldn't believe it."

Higgins said she's still dumbfounded as to what happened that day.

"I still can't believe that I didn't brake, or I didn't swerve... and there's no marks on the road," she said.

The only evidence of the crash is the car, which had its windshield pushed into Higgins's lap; the roof peeled back, just shy of her head; and moose fur all over the inside of the vehicle – and even in her purse.

The moose was left by the road.

Seven months later, Higgins is still recovering from those injuries. She has occasional dizziness and shoulder pain, despite months of physiotherapy.

While she can't remember the crash, the world has not forgotten. Her story went viral, landing news coverage from CNN to the U.K.'s Daily Mail, and spreading via email and Facebook.

"From New York, to China, to Paris, to all around Canada, there are people trying to add me on Facebook, from Sri Lanka – everywhere," she said.

Even though Higgins drives past the same spot where the accident occurred almost every day, it still hasn't jogged her memory.

"It drives me totally insane," she said.

After seeing doctors and obsessing about just what happened that day, Higgins does have one theory in mind.

"It's like my mind knows it's going to Gander... going to work, and it brought me there." she said.

"It's almost like I was on autopilot, and didn't know it."

Her mind obviously shut down that part that was so tramatizing.

this isn't just an assault weapons ban

i can't take gun control advocates seriously unless they also consider disarming the police and military - we have the 2nd amendment for a very specific purpose. how quickly we forget how this country was founded, armed revolution against a tyrannical government.

http://www.feinstein.senate.gov/publ...ssault-weapons

Summary of 2013 Feinstein Assault Weapons Legislation

Bans the sale, transfer, importation, or manufacturing of:

 120 specifically-named firearms
 Certain other semiautomatic rifles, handguns, shotguns that can accept a
detachable magazine and have one military characteristic
 Semiautomatic rifles and handguns with a fixed magazine that can accept
more than 10 rounds

Strengthens the 1994 Assault Weapons Ban and various state bans by:

 Moving from a 2-characteristic test to a 1-characteristic test
 Eliminating the easy-to-remove bayonet mounts and flash suppressors from the characteristics test
 Banning firearms with “thumbhole stocks” and “bullet buttons” to address attempts to “work around” prior bans

Bans large-capacity ammunition feeding devices capable of accepting more than 10 rounds.

Protects legitimate hunters and the rights of existing gun owners by:
 Grandfathering weapons legally possessed on the date of enactment
 Exempting over 900 specifically-named weapons used for hunting or sporting purposes and
 Exempting antique, manually-operated, and permanently disabled weapons

Requires that grandfathered weapons be registered under the National Firearms Act, to include:
o Background check of owner and any transferee;
o Type and serial number of the firearm;
o Positive identification, including photograph and fingerprint;
o Certification from local law enforcement of identity and that possession would not violate State or local law; and
o Dedicated funding for ATF to implement registration

Ison - the comet of the century

'Brighter than a full moon': The biggest star of 2013... could be Ison - the comet of the century

At the moment it is a faint object, visible only in sophisticated telescopes as a point of light moving slowly against the background stars. It doesn't seem much – a frozen chunk of rock and ice – one of many moving in the depths of space. But this one is being tracked with eager anticipation by astronomers from around the world, and in a year everyone could know its name.

Comet Ison could draw millions out into the dark to witness what could be the brightest comet seen in many generations – brighter even than the full Moon.

It was found as a blur on an electronic image of the night sky taken through a telescope at the Kislovodsk Observatory in Russia as part of a project to survey the sky looking for comets and asteroids – chunks of rock and ice that litter space. Astronomers Vitali Nevski and Artyom Novichonok were expecting to use the International Scientific Optical Network's (Ison) 40cm telescope on the night of 20 September but clouds halted their plans.

It was a frustrating night but about half an hour prior to the beginning of morning twilight, they noticed the sky was clearing and got the telescope and camera up and running to obtain some survey images in the constellations of Gemini and Cancer.

When the images were obtained Nevski loaded them into a computer program designed to detect asteroids and comets moving between images. He noticed a rather bright object with unusually slow movement, which he thought could only mean it was situated way beyond the orbit of Jupiter. But he couldn't tell if the object was a comet, so Novichonok booked time on a larger telescope to take another look. Less than a day later the new images revealed that Nevski and Novichonok had discovered a comet, which was named Comet Ison. A database search showed it has been seen in images taken by other telescopes earlier that year and in late 2011. These observations allowed its orbit to be calculated, and when astronomers did that they let out a collective "wow."

Comet Ison has taken millions of years to reach us travelling from the so-called Oort cloud – a reservoir of trillions and trillions of chunks of rock and ice, leftovers from the birth of the planets. It reaches out more than a light-year – a quarter of the way to the nearest star. In the Oort cloud the Sun is but a distant point of light whose feeble gravity is just enough to hold onto the cloud. Every once in a while a tiny tug of gravity, perhaps from a nearby star or wandering object, disturbs the cloud sending some of its comets out into interstellar space to be lost forever and a few are scattered sunward. Comet Ison is making its first, and perhaps only visit to us. Its life has been cold, frozen hard and unchanging, but it is moving closer to the Sun, and getting warmer.

Ison's surface is very dark – darker than asphalt – pockmarked and dusty with ice beneath the surface. It's a small body, a few tens of miles across, with a tiny pull of gravity. If you stood upon it you could leap 20 miles into space taking over a week to come down again, watching as the comet rotated beneath you. You could walk to the equator, kneel down and gather up handfuls of comet material to make snowballs, throw them in a direction against the comet's spin and watch them hang motionless in front of you. But it will not remain quiet on Comet Ison for the Sun's heat will bring it to life.

By the end of summer it will become visible in small telescopes and binoculars. By October it will pass close to Mars and things will begin to stir. The surface will shift as the ice responds to the thermal shock, cracks will appear in the crust, tiny puffs of gas will rise from it as it is warmed. The comet's tail is forming.

Slowly at first but with increasing vigour, as it passes the orbit of Earth, the gas and dust geysers will gather force. The space around the comet becomes brilliant as the ice below the surface turns into gas and erupts, reflecting the light of the Sun. Now Ison is surrounded by a cloud of gas called the coma, hundreds of thousands of miles from side to side. The comet's rotation curves these jets into space as they trail into spirals behind it. As they move out the gas trails are stopped and blown backwards by the Solar Wind.

By late November it will be visible to the unaided eye just after dark in the same direction as the setting Sun. Its tail could stretch like a searchlight into the sky above the horizon. Then it will swing rapidly around the Sun, passing within two million miles of it, far closer than any planet ever does, to emerge visible in the evening sky heading northward towards the pole star. It could be an "unaided eye" object for months. When it is close in its approach to the Sun it could become intensely brilliant but at that stage it would be difficult and dangerous to see without special instrumentation as it would be only a degree from the sun.

Remarkably Ison might not be the only spectacular comet visible next year. Another comet, called 2014 L4 (PanSTARRS), was discovered last year and in March and April it could also be a magnificent object in the evening sky. 2013 could be the year of the great comets.

As Comet Ison heads back to deep space in 2014 the sky above it would begin to clear as the dust and gas geysers loose their energy. Returning to the place where the Sun is a distant point of light, Comet Ison may never return. Its tail points outward now as the solar wind is at its back, and it fades and the comet falls quiet once more, this time forever.
